Welcome to OhColoring (“OhColoring,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of ohcoloring.com and any related mobile sites, applications, or services (collectively, the “Site”).
By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use the Site. If you are under 18, you represent that you have permission from a parent or legal guardian, who agrees to be bound by these Terms on your behalf.

2. Changes to the Terms

We may update these Terms at any time. When we do, we will revise the “Effective Date” above and, where appropriate, notify you by email or a prominent notice on the Site. Your continued use of the Site after the new Terms take effect constitutes acceptance of the changes.

3. License to Use the Site & Content

  1. Our Content. All text, graphics, images, coloring pages, and other material provided by OhColoring (“Site Content”) are protected by copyright and other laws.
  2. Your Limited Rights. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to download, print, and color Site Content for non-commercial, personal use only. Any commercial use (e.g., selling prints, including in paid apps, or using in merchandise) requires our prior written permission.
  3. No Derivative Distribution. You may modify Site Content for your personal coloring activities, but you may not redistribute, repost, or publish modified or original files online or offline without explicit consent.

4. User Conduct

You agree not to:

  • Violate any law or regulation;
  • Infringe copyright, trademark, or other rights;
  • Upload, post, or transmit unlawful, harmful, or obscene content;
  • Interfere with or disrupt the Site’s operation or security;
  • Use bots, scrapers, or other automated means to access the Site without authorization;
  • Attempt to reverse-engineer any portion of the Site.

5. Accounts

Creating an account is optional. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.

6. User Submissions

If you submit feedback, suggestions, or your own coloring artwork (“User Content”) you grant OhColoring a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, display, and distribute that User Content in any medium for any purpose, without compensation to you. You represent that you have all rights needed to grant this license.

7. Intellectual Property

“OhColoring,” our logos, and all related names are trademarks of OhColoring or its licensors. You may not use them without prior written permission.

8. DMCA Copyright Policy

We respect intellectual-property rights. If you believe any material on the Site infringes your copyright, please send a notice compliant with the Digital Millennium Copyright Act (“DMCA”) to: [email protected]. We will respond and, if appropriate, remove the material or disable access.

9. Third-Party Links & Ads

The Site may contain links to third-party websites or display ads (“Third-Party Services”). We do not control and are not responsible for Third-Party Services; access them at your own risk.

10. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING TITLE, NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE.
We do not guarantee that the Site will be uninterrupted, secure, or error-free.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OHCOLORING WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE, EVEN IF WE WERE ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS WILL NOT EXCEED USD 50 OR THE AMOUNT YOU PAID US, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify and hold harmless OhColoring, its affiliates, officers, employees, and agents from any claim, demand, loss, or damages (including attorneys’ fees) arising out of or related to your use of the Site or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Site, without notice or liability, for any reason, including if we believe you have violated these Terms. Upon termination, Sections 6–15 will survive.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. All disputes that are not subject to arbitration (see below) must be brought exclusively in the state or federal courts located in San Francisco County, California, and you consent to their jurisdiction.

15. Dispute Resolution & Arbitration

PLEASE READ THIS SECTION CAREFULLY. It affects your rights.

  1. Informal Resolution. Contact us first to attempt to resolve any dispute informally.
  2. Binding Arbitration. If we cannot resolve the dispute within 30 days, either party may require the other to submit the dispute to final and binding arbitration under the rules of the American Arbitration Association.
  3. Class-Action Waiver. Disputes must be resolved individually; you and OhColoring waive any right to participate in class actions or class-arbitrations.
  4. Exceptions. You may assert claims in small-claims court if they qualify.

16. International Users

The Site is controlled and operated from the United States. If you access the Site from outside the U.S., you are responsible for compliance with local laws.

17. Severability & Entire Agreement

If any provision of these Terms is held invalid, the remaining provisions will remain in full force. These Terms constitute the entire agreement between you and OhColoring regarding the Site and supersede all prior agreements.
